What Workers Compensation Covers

Medical Benefits

Pays all reasonable medical expenses for an employee injured on the job, including emergency care, surgery, physical therapy, and prescription drugs. No deductible for the employee.

Lost Wage Replacement

Pays a portion of an employee's wages while they are unable to work due to a covered injury. Georgia pays two thirds of the employee's average weekly wage up to the state maximum.

Employer Liability

Protects the business from lawsuits by injured employees who claim negligence beyond the standard workers comp benefit. Provides legal defense and covers settlements.

Death Benefits and Vocational Rehab

Georgia provides Death Benefits to surviving dependents of workers killed on the job and Vocational Rehabilitation for permanently disabled workers unable to return to their prior occupation. Both are mandatory components of every Georgia WC policy.

What Workers Compensation Does Not Cover

Independent Contractors

Workers comp typically does not cover independent contractors. However, if a contractor is misclassified and acts like an employee, you may have exposure. Review contractor relationships carefully.

Injuries Outside Work

Only injuries that occur in the course of employment are covered. Injuries during a commute or personal activity are excluded.

Intentional Self-Injury

Claims where an employee intentionally injures themselves to collect benefits are excluded. Fraud investigation is standard for suspicious claims.

Substance Impairment

Injuries that occur while an employee is under the influence of drugs or alcohol are typically excluded or have reduced benefits.
